Swedish Court Says Public Masturbation Not A Crime
A surprising court ruling has set precedent on public masturbation after a 65-year-old Swedish man was acquitted of sexual assault after pleasuring himself on a beach in Stockholm in June of 2013.
The gentlemen was visiting the Drevviken beach June 6, 2013 when he removed his shorts and began masturbating near the water. He was picked up by local authorities and charged with sexual assault, a criminal offense in Sweden. When the time came for a court ruling, The Södertörn District Court acquitted the man because the he was not targeting anyone with his gesture. In order for the charge of sexual assault to stick, it would have to be proven that he targeted an individual with his actions. Since the man was just simply pleasuring himself, and not attempting to assault anyone in particular the charges we dropped.
Public prosecutor Olof Vrethammar said:
“For this to be a criminal offence it’s required that the sexual molestation was directed towards one or more people. I think the court’s judgement is reasonable. The district court has made a judgement on this case. With that we cannot conclude that it is okay to masturbate on the beach. The act may be considered to be disorderly conduct.”
So, with that being said, there is a chance that you might be charged with something else other then sexual assault, like public indecency, but at least that’s not a criminal charge.
