After all, many user-uploaded porn sites rely on the “safe harbor” loophole in the DMCA that assumes that user-uploaded sites aren’t aware when their content is copyright-infringing. As long as these sites delete the content when demanded, they’re in the clear as far as the DMCA is concerned.

The twist on this scenario that’s been happening in the porn industry occurs on user-uploaded porn tubes. A recent Xbiz article alleges that some porn tubes are knowingly uploading infringing content (or paying others to do it for them) then removing the videos when requested. Once a video’s been removed, however, it’s then sent back to the upload department who re-uploads it. Xbiz argues that this cycle is causing the porn industry immensely. In fact, USA Today quoted Steve Hirsch, founder of Vivid Entertainment, as saying that DVD sales plunged 20% last year.

While such changes are affecting the industry, it’s important to keep in mind that not all porn tubes are alike. Yes, some porn tubes are allegedly uploading content under the guise of user-uploaded content. However, other porn tubes, like Orgasm.com, actually function under affiliate partnership deals. This means that 100% of our content is legally obtained through the relationships we have with the porn studios who created it. Just remember: not all free porn is bad and not everything you hear about porn tubes applies to us.

As an outsider looking in it would seem that the relationship between Braun and Vivid is a good one. This coming a mere week after the trailer for Batman XXX, parodying the 1960′s campy televisision show, hit the interwebs making it the most watched viral online today. As an aside, I must say that the trailer is amazing. I know it doesn’t mean much since you know I’m already a Batman lunatic, but I’m really looking forward to trying, and probably ultimately failing, to talk my wife into watching it.

Documents actually exist that layout the plans for Wilkinson to form a side company a year and a half ago, for the sole purpose of shopping the sex tape around to release it herself. It’s unclear whether or not that company includes her sports hubby Hank Baskett, who apparently is NOT distraught and on the verge of divorcing his new wife. Apparently the unnamed third party AND Vivid-head Steven Hirsch beat her to it, and she’s none to happy.

I will admit to being somewhat amused when she was a regular on the original incarnation of The Girls Next Door; the reality show that documented the lives of Hugh Hefner, Playboy overlord, and his 3 blonde haired, big-titted bedfellows. That show also featured Holly Madison and Bridget Marquardt, both of whom have gone on to star in their own assortment of E! malaise. That line-up ended the fifth season with the 3 girls moving out of the Playboy mansion, easily the second most famous L.A. landmark next to the Hollywood sign.

Some people can be dumb and make you think how cute they are. Not Kendra. When the show featured the creation of her theme song by Play-N-Skillz and Too $hort and Kendra proceeds to explain how “old school” and “on top of their game” they are, I could only reflect upon my years working in a record store in the early 90′s when that statement was actually true.

ANYWAY, Vivid has located an intimate video with Kendra and a, as of yet unidentified, sex partner (it takes place before her meeting and marrying Philadelphia Eagles receiver Hank Baskett) made prior to her moving into the Playboy mansion. If you’ve seen the E! True Hollywood Story: Kendra Wilkinson you can probably surmise, as have I, that this will most likely take place during her admitted drug-fueled days. Which is sorta juicy.

“Kendra Exposed” will be distributed under the Vivid-Celeb imprint and Kendra will join such celebrities as Pamela Anderson and Tommy Lee, Kim Kardashian and Ray J, former Miss USA Kelli McCarty, Shauna Sand, Mindy McCready and others whose sex tapes have also been released by Vivid.

“The tape was brought to us by a third party and after consulting with our attorneys, we are confident in our right to distribute it.” says Vivid founder and co-chairman Steven Hirsch. If you have any doubt as to Steve’s legal rights you need look no further than this.

So bring it on! If she can shut her mouth long enough to provide simple eye candy for the voyeur in us all then I may be a willing participant.

But this just cracks me up. All the lawyers…all the threats…and what did Vivid Entertainment President Steven Hirsch produce? A signed release. Signed by MINDY McCREADY! Was she so high she doesn’t remember signing it…or is she so high as to think anyone would forget?

So I told myself a long time ago; fuck it. I’m going to write fun things at, pretty much the expense of anybody who’s going through something noteworthy. Be it a divorce, jail, rehab, or in this repetitive case, a sex tape. And this weeks star; Country Westerns’ girl-next-door-who-waits-for-you-to-leave-and-fucks-your-man-when-you’re-not-home; Mindy McCready.

A. I’m not a Baseball fan. So I don’t really give a rats ass WHO Roger Clemens is…was…or will soon find himself playing on the usual mishmash of reality shows.

B. Mindy McCready is bat-shit crazy.

The point of this posting is to reveal that somehow someway she was able to get Vivid Entertainment‘s Steve Hirsch (my hero) to DELAY the release of her highly anticipated sex video, where she dishes on not only Clemens, but the other as sundry of celebrities and sports personalities that she has had “relations” with. She also looks like she was pretty fucking hot when it was made.

On one hand I feel bad for Mindy, having followed her on her sobriety path with VH1′s Celebrity Rehab and Sober House, both featuring the busy Dr. Drew Pinski. But then later she apparently (here’s where I get dishy) moved into the home of co-star and hotly debated villainess Kari Ann Peniche (who I have fantasies of punching in the face that I won’t act out on) and forcing her to call in the police to have her removed.

So that kinda makes me say “play ball!”

“We’ve decided to take a little extra time to study all of our documentation and other clearances before we proceed,” Mr. Hirsch said. “I want a chance to review the correspondence from Mindy’s attorney, Adam Dread, and to prepare a proper response to the letter he has sent to us.”

So she wins for now. But history has shown that Vivid is pretty good at covering their asses, and if they have something to release it may very well be within their right to release it. To this I say; Opt in for the payout McCready. Because chances are you you won’t be given a choice in the matter later.

McCready’s lawyers have apparently made a bunch of demands that Hirsch is laughing at. He is calling them ‘presumptuous.’ Boy would I love to be a fly on the wall in his legal departments war room.

Ahhhh piracy in porn. Why pay for something when you can get it for free? That has been the question to plague industry cattle reigners for the last 15 years. When pontificating upon adult entertainment and its marriage with the internet, one must remember that porn figured out how to make money on the web before anyone else did. So it stands to reason that we should continue to lead the trend forever.

Tonight, Nightline ABC once again takes a look at porn and asks the aforementioned “Why Would You Ever Pay For Porn?”

Luckily they speak mostly to those who are indeed worthy of their quotes. Steve Hirsch from Vivid Entertainment (there’s that name again) and AVN publisher Paul Fishbein are both more than fair representation of the industry and speak frankly and succinctly about a subject that they sometimes simply cannot avoid. The meat of the special was filmed during the AEE / AVN Awards this last January.

Without turning this into a political speech, driving one side home or the other, there is a couple things I want to say. Orgasm.com of course falls into the category of free internet porn. But this should never be mistaken for pirated porn. We, as a company, have always been extremely honest in our determination to acquire the very best content…either licensed or through affiliation. We’ve had to be. Everyone should obviously understand that it is still a business and businesses need to make money in order to survive, and hopefully fulfill their goals of offering the best possible product. Porn companies are no different. But what is so awesome about the adult industry, free sex porn sites, tube-sites and pornography in general is, instead of going after companies who find innovative ways of making money on the internet and then targeting them to the point of extinction (a practice made very popular by corporate America), porn realized the simple economics of it: how do we compete with free?

We don’t. So let’s try to find another way.

It’s like the music industry without the douchbaggetry. And that is something to be very proud of.

Porn isn’t going anywhere. We the companies. You the fan. As I’ve said before, it’s love at first sight…it’s a pairing of the obvious…it’s a match made outside of eHarmony. But it feels good too when it’s right and just.
